I think Seth is saying that Commerce Dept. is trying to limit the loss
of its policy control by limiting the exception to a form of
distribution (open source) that is unpalateable to most programmers.

Please note that Commerce's definition of "open source" for purposes
of this exception is the ideosyncratic one I just quoted, not one that
you or I would use.

You could adopt the Hanlon's Razor interpretation, and suggest the rule
was simply drafted by someone unclear on the concept -- or cleverly to 
just barely allow Bernstein's victory but few others' -- or mix the two
interpretations to suit.  Either way, by a strict reading, shareware
would seem excluded.  But you never know for sure until the rule is 
applied a few times.
