We had that in the fair use provision of the Copyright Act pre-DMCA.

The DMCA gives those who would distribute copyrighted works the power to
take ANY OTHER ARBITRARY CONTROL over the work IN ADDITION to those
limited exclusive rights granted by the copyright act simply by enabling
a "technological protection measure", however poorly.
