Since the Javurscript does not qualify as:
 1. Spamming;
 2. Copyright Violation;
 3. Distribution and/or Transmission of Obscene or Indecent Speech or
Materials;
 4. Defamation;
 5. Illegal/Unauthorized Access to Other Computers or Networks;
 6. Distribution of Internet Viruses, Worms, Trojan Horses and Other
Destructive Activities; or
 7. Export Control Violations; it must therefore be included under:
 8. Other Activities, whether lawful or unlawful, that Verio
     determines to be harmful to its subscribers, operations or
     reputation, including any activities that restrict or inhibit any
     other user from using and enjoying the service or the Internet.

What makes this particularly precious, is the following clause:

     As we have pointed out, the responsibility for avoiding the harmful
     activities just described rests primarily with the subscriber. . .
     .When Verio becomes aware of harmful communications, however, it
     may take any of a variety of actions. Verio may remove information
     that violates its policies, implement screening software designed
     to block offending transmissions, or take any other action it deems
     appropriate, including termination of a subscriber's contract with
     Verio.

So, in other words, you can be responsible for "other lawful activities that
VERIO DETERMINES to be harmful" but "the responsibility for avoiding the
harmful activities rests primarily with the subscriber."  In consequence of
Verio's determination that an activity is harmful, they can "remove
information, block transmissions, or take any other action."
