Well, I wouldn't want to go that far.  If a US citizen who happens to have 
(legally) posession of national security secrets (real ones), and happens 
to find himself in Libya, one would really like U.S. espionage law to apply.

On the other hand, a Libyan citizen in Libya -- screw the US, they 
shouldn't have given him the damn secrets.
