You're missing the point:

   Terms of the contract are *NOT* available prior to purchase.

The broader point is that publishers are attempting to portray licensing
of material as an acceptable alternative to copyrighting it.

If the publishers aren't going to utilize the protections offered by
copyright, and instead resort to licensing, what obligation does the
public have to grant publishers copyright privileges?
