Please read the defendants' briefs and the briefs of amici curiae in
support of them from _Universal v. Reimerdes_.  They show great
sophistication and depth.

You can find them easily at EFF's and Cryptome's web sites.

You might also enjoy reading the complaint in _Felten v. RIAA_.
