Oral argument is scheduled for Monday 7 October 2002 at 14:00 in
Courtroom 15, 18th Floor, Federal Building, 450 Golden Gate Avenue,
   San Francisco, California.

I'm advised that Bernstein is currently proceeding pro se; see

http://cr.yp.to/export/2002/08.02-bernstein-subst.pdf

I'm not sure if I'll be around to attend this argument. (The Federal
Building is near the Civic Center BART; it's the same building where we
protested to free Dmitry last summer.)

EFF previously sponsored this case, which resulted in the first
holding by a U.S. court that computer software is constitutionally
protected speech. However, a legal maneuver by the government
stripped away the precedential authority of the earlier decisions.
Professor Bernstein is back in court at the lowest level of the
Federal court system, trying to convince the court to reiterate and
expand upon its earlier holding.
