Oral argument in Kahle v. Ashcroft for the government's motion to
dismiss has been scheduled here in SF on Oct. 29 @ 9 a.m. in front of
Judge Maxine Chesney. This is a new constitutional copyright
challenge to the CTEA as applied to orphan works brought by Larry
Lessig. The main theory is that removal of the registration and
renewal requirements for these works in conjunction with copyright
extension, is an as applied first amendment violation because it
changed the traditional contours of copyright law.
